Tradesperson with tools in a van: when can they be exempt from CQC?

The exemption may apply if the driver uses the equipment in their own work and driving is not their main activity.

A tradesperson may qualify for the CQC exemption for materials or equipment used in their own work if driving the vehicle is not their main activity. Tools being present in a van is not enough: the driver must use them in their trade. Any required C1/C licence still applies.

The exemption conditions work together

Legislative Decree 286/2005 exempts a driver who transports materials or equipment they themselves use in their work, provided that driving is not their main activity. The rule concerns the actual use: a tradesperson drives to a worksite to use their tools, rather than mainly providing a professional goods-transport service.

This exemption does not automatically cover every company van or a driver carrying tools for someone else. MIT says that this and the private non-commercial transport exemption do not apply to an employee hired as a professional driver. Consider the person’s job, employment relationship, how the equipment is used and the main activity.

Driving licence and CQC are separate

CQC is a professional qualification; the driving licence authorises a vehicle category. If the van or truck has a maximum authorised mass requiring C1/C, an exemption from CQC does not remove the need for that category. Check the vehicle document for mass, seats, trailer and licence restrictions.

If you combine hands-on work with transport, keep records that show the purpose of the trip and the equipment’s use: a work order, job assignment or equipment list can help explain the facts to an employer or authority. It does not automatically establish an exemption. If driving is actually your main activity, do not rely on this exception.

Example

A plumber drives a C1 vehicle carrying pipes and tools that they will use at a customer’s home, and plumbing is their main work: the exemption may apply if the other conditions are met. A professional driver hired to deliver equipment to multiple sites does not personally use those tools in another trade; their van carrying tools alone does not qualify them for the exemption.

Quiz Patente Ufficiale helps review theory quizzes and mistakes; a CQC exemption depends on the driver’s role and equipment use, not simply the van.

Frequently asked questions

Is carrying work tools enough to be exempt?

No. The driver must use the tools in their own work, and driving cannot be their main activity.

Does a CQC exemption let me drive a truck without C1 or C?

No. The driving licence and professional qualification are separate; you still need the category required for the vehicle.
