Helmets on motorbikes and scooters: requirements and correct use
Who must wear a helmet on mopeds and motorbikes, and what checks should be carried out before setting off.
Article 171 requires drivers and passengers of mopeds and motorcycles to wear an approved and properly fastened helmet, subject to specific exceptions.
Obligation for drivers and passengers
Whilst riding, the driver of a moped or motorbike and any passenger must wear a protective helmet conforming to an approved type and keep it properly fastened. This requirement is not limited to the driver or to journeys within built-up areas: it also applies to short journeys and to anyone travelling on the rear seat. The exemptions provided for by law relate to specific vehicle configurations with a closed body or safety cage, not to a helmet that is left open or unfastened.
Choose a helmet of the correct size, check the label and type-approval, and fasten the strap according to the instructions. A helmet that moves around, is worn out or has suffered a significant impact may not provide adequate protection. Follow the manufacturer’s instructions regarding lifespan, cleaning and replacement. Do not buy a helmet based solely on its appearance or the presence of a visor: type-approval and fit are crucial.
- Type-approved helmet for rider and passenger.
- Strap fastened correctly before setting off.
- Replace or have the helmet assessed after a significant impact.
How to wear and store it
The shell must fit snugly without any painful pressure points and must not rotate freely when the strap is fastened. Choose the size according to the manufacturer’s guide and, if possible, try the helmet on. Avoid dropping it or exposing it to solvents, heat and substances that may damage the materials. Unauthorised painting or modification may affect its performance and void the warranty.
Passengers must also have a helmet that fits them properly. Do not share a helmet that does not fit or is damaged. Before setting off, check the visor, fastening and visibility; a correctly fastened helmet does not eliminate the risk of an accident, so ride with caution and take road conditions into account.
The relevant legislation
A clean, scratch-free visor improves visibility, but does not replace the requirement to wear a helmet. In the event of rain, mist or poor light, use suitable accessories and reduce your speed; do not open the visor if this compromises protection. If you are carrying a passenger, check that they are seated correctly and wearing a suitable helmet before setting off. For children, check that the vehicle and seat allow them to be carried in accordance with current regulations.
