Road rules
Can a van carry material that may spill on a motorway?
Only if it is contained and secured against spillage. Article 175 excludes open or non-watertight vehicles carrying loose material.
A van may not enter a motorway with material that can fall or escape from an open or non-watertight compartment. Contain and cover it when needed, and secure it under Article 164.
Prevent any material from escaping
Article 175 excludes open or non-watertight vehicles carrying material liable to spill when the load is not properly arranged and protected. The purpose is to stop gravel, soil, leaves, liquids or other material from reaching the road, obstructing visibility or striking other users. A cover must suit the load and be secured so airflow cannot lift it.
Article 164 also requires a load to be arranged so it cannot fall or shift, impair visibility or affect vehicle stability. Closing the rear doors is not enough if material can escape through openings or gaps. Liquids or dusty material may need a sealed container or a suitable covering system.
Inspect the container, cover and restraints
Before leaving, inspect the compartment from outside, check the closures and cover, and make sure the load will remain contained while braking and turning. If material appears on the body or road after a few kilometres, stop safely and fix the problem before continuing. A short trip or calm weather does not remove the risk or the legal requirement.
For example, closed, secured bags in an intact van differ from loose sand in an uncovered open bed. In the second case, do not enter a motorway until the material is contained. Frequently asked questions
Is a cover enough?
Only if it truly contains the material and is firmly secured. Also consider the material, compartment and Article 164 requirements.
Can I drive a short distance to the next exit?
Not if the load may spill or endanger traffic. Secure it before entering the road.
