Minibus with 16 passengers: D1 or D licence?

D1 may cover 16 passengers besides the driver if the vehicle is no longer than 8 metres; check approved seats and length.

D1 may cover a vehicle designed for up to 16 passengers besides the driver and no longer than 8 metres. If the vehicle exceeds either limit, assess category D. The approved passenger capacity matters, not how many people ride on a particular trip.

D1 limits both passenger count and length

Category D1 covers vehicles designed for no more than 16 passengers besides the driver and no longer than 8 metres. A minibus approved for 16 passengers plus the driver can therefore fit D1 if its length and registration data match. Category D covers vehicles designed for more than eight passengers besides the driver and does not have D1’s 16-passenger and eight-metre limits.

D1 and D overlap for vehicles within D1’s limits: D1 may be sufficient if the minibus meets both conditions. A vehicle approved for more than 16 passengers or longer than 8 metres needs D to be assessed. Temporarily empty seats or unoccupied places do not change the vehicle’s approved configuration.

Read the minibus registration document

Check the registered passenger capacity, length, category and mass. If the minibus has been converted, make sure the new layout was approved and recorded. The commercial name “minibus” does not determine the category, and the driver is not included in the limit of 16 passengers.

If the minibus is used professionally to transport people, CQC passenger qualification may also be required. D1 or D is the driving category; CQC is a separate qualification linked to the activity. For private non-commercial use, check whether an exemption applies rather than inferring one from vehicle ownership.

Example

A minibus approved for 17 occupants in total, including the driver, and 7.5 metres long may fit D1: that is 16 passengers besides the driver. A vehicle approved for 18 total occupants exceeds the D1 passenger limit; a vehicle longer than 8 metres exceeds its length limit too. Confirm the official configuration before driving.
