Can you drive a private bus with category D but no CQC?

Category D authorises the vehicle; CQC concerns professional transport, while private non-commercial use may be exempt.

Yes, a genuinely private, non-commercial journey may qualify for the CQC exemption, but you still need category D for the bus. If you are driving as a professional or providing a transport service, do not assume the exemption: check the activity, employment relationship and statutory conditions.

Category D and CQC serve different purposes

Category D authorises buses designed for more than eight passengers besides the driver. CQC passenger qualification is a separate requirement for drivers who professionally transport passengers in D and related vehicles. Holding D does not automatically exempt you from CQC, and CQC does not replace the driving category.

Legislative Decree 286/2005 lists private, non-commercial passenger transport among CQC exemptions. A personal trip on a privately held bus may fit if the conditions are met. Simply using a vehicle privately does not necessarily exempt a driver who is employed as a professional bus driver.

Assess the purpose and the driver’s role

Establish who arranged and paid for the journey, whether passengers are being charged and what the driver’s job is. MIT states that own-use exemptions do not apply when the driver is employed by a company as a professional driver. A bus used for a professional service does not become private only because an association or company owns it.

Also check the vehicle’s passenger capacity, mass, length and category: D may still be required even when CQC is not. For a special journey organised by an organisation, ask the service manager to document why the exemption applies. Do not rely only on “own use” wording or vehicle ownership.

Example

An association uses its bus for a members’ outing, does not sell transport and does not employ a driver: the private non-commercial exemption may be relevant. A transport company instead runs a paid trip with an employee hired as a driver; that professional service requires a separate check for passenger CQC as well as category D.
