Can I drive a vehicle with eight passengers on category B?

Yes, if it carries eight passengers plus the driver and also meets category B’s mass limit.

Yes. Category B covers motor vehicles designed for no more than eight passengers in addition to the driver, so nine people in total. You must also check that the vehicle’s maximum authorised mass does not exceed 3,500 kg and that the vehicle is approved for those seats.

Count passengers, not total seats

Under the Italian Highway Code, category B covers motor vehicles designed to carry no more than eight people in addition to the driver. The driver is not one of those eight passengers. A vehicle with nine seats in total can therefore carry the driver and eight passengers, provided its approval and the other requirements are met.

The authorised seating capacity must appear in the vehicle documents; physical seats or seat belts alone are not enough. Do not add seats, remove them or change the layout without the required approvals. Maximum authorised mass matters too: category B normally stops at 3,500 kg. Italy has a narrow exception for some alternative-fuel goods vehicles without a trailer, but it does not apply to a passenger minibus.

Example: nine seats in total

A van approved for nine occupants including the driver is within the numerical category B limit if its maximum authorised mass is no more than 3,500 kg. If the document lists ten seats in total, that generally means a driver plus nine passengers. The category B passenger limit is exceeded, so a D category must be considered. D1 may cover certain vehicles with up to 16 passengers plus the driver and a maximum length of eight metres.

Do not confuse the approved seats with the number of people on one trip. The vehicle category is based on its design and approval; an empty seat does not turn a category D vehicle into a category B vehicle. For the same reason, an online listing does not replace the vehicle registration certificate.

Check how the vehicle will be used

Before driving, read the number of seats, vehicle category and maximum authorised mass in the documents, and check any restrictions on your licence. Professional passenger transport may also require a qualification such as CQC: a driving category and a professional qualification answer different questions. Ask the competent office to check an imported or converted vehicle. Quiz Patente Ufficiale helps you review licence categories and common rules with theory quizzes.
