Minibus with nine passengers: which licence do you need?
With nine passengers plus the driver, category B is not enough; check D1 or D using the approved seats, length and vehicle class.
For a minibus designed for nine passengers in addition to the driver, category B is not enough: it stops at eight passengers plus the driver. You must consider a D category. D1 may cover vehicles for up to 16 passengers plus the driver and no more than eight metres in length.
Nine passengers exceed the category B limit
The category B passenger limit is measured in addition to the driver. B covers a motor vehicle designed for no more than eight passengers plus the driver, or nine people in total. If a minibus is approved for nine passengers and a separate driver, it exceeds that limit.
Category D1 covers vehicles designed to carry no more than 16 passengers in addition to the driver and with a maximum length of eight metres. If the vehicle exceeds either limit or has a different configuration, D may be required. Do not decide from the commercial label “minibus”: check the registered category and seats on its vehicle documents.
Empty seats do not change the category
The approved configuration matters, not how many passengers happen to board on one trip. A minibus approved for ten people in total does not become a category B vehicle just because only eight passengers are travelling today. Nor can seats removed informally be ignored: a conversion must be approved and recorded under the applicable rules.
Check the maximum authorised mass and any restrictions on your licence as well. D1 or D identifies the vehicle class; professional passenger transport may also require an additional qualification such as CQC for passenger transport. The licence category and the professional qualification are separate requirements.
What to check before driving
Read the minibus documents for the number of seats, length, vehicle category and mass. Compare these details with Article 116 and the MIT D1 and D guidance. For an imported or converted vehicle, or an unclear seating count, ask the Motor Vehicle Office. Do not rely only on a rental listing or the operator’s description.
For example, a vehicle with 12 seats including the driver and a length of 7.5 metres may fall within D1 if its registered classification confirms it. With 17 passengers plus the driver, D1 does not cover it. The vehicle documents provide the facts for the specific case.
